Thailand has recently undergone significant changes in its hemp and cannabis regulations, making it one of the more progressive countries in Asia regarding cannabis policy. Here’s an overview of the current regulations, recent legislative changes, and the status of inhalable CBD products:

Cannabis and Hemp Regulations

  1. Medical Cannabis Legalization:
    • In 2018, Thailand became the first Southeast Asian country to legalize cannabis for medical use and research. The Narcotic Act of 1979 was amended in December 2018 to allow this change.
  2. Decriminalization and Partial Legalization:
    • In June 2022, Thailand decriminalized cannabis by removing it from the Category 5 narcotics list. This change allowed individuals to grow and possess cannabis. However, public consumption and the sale of cannabis extracts containing more than 0.2% THC are still regulated.
  3. Regulations for Use and Sale:
    • The use of cannabis for recreational purposes in public places is prohibited, and it can attract fines and potential jail time if it disturbs the public peace.
    • As of the latest changes, cannabis can be sold and used legally, provided that THC levels in products do not exceed 0.2%. Products exceeding this limit are still considered controlled substances under the Narcotics Act.

CBD Regulations

  1. CBD Products:
    • Alongside the decriminalization of cannabis, CBD derived from cannabis is no longer considered a narcotic as long as it contains less than 0.2% THC. This aligns with the regulations for hemp-derived CBD, which is also legal under the same THC threshold.

Recent Legislative Attempts

  • Health Regulations: Following the decriminalization in June 2022, the Thai Food and Drug Administration (FDA) and the Public Health Ministry have been working on developing more detailed regulations to manage the use, cultivation, and sale of cannabis and CBD products. These regulations aim to ensure public safety while allowing the benefits of cannabis and hemp.
  • Control Measures: There have been proposals to prevent the misuse of the more relaxed laws, such as registration requirements for growers and sellers, and regulations aimed at keeping cannabis out of the hands of minors and preventing its use in public spaces.

Inhalable CBD Products

  • Vaporizers and Other Inhalable Products:
    • With the legalization of cannabis and CBD products containing less than 0.2% THC, inhalable products such as CBD vaporizers are legally available in Thailand. These products must comply with the THC content restrictions and are subject to regulations that may govern their marketing and sale.

Thailand’s approach to cannabis and hemp is unique in the region, as it has moved towards a model that allows for widespread cultivation and use while trying to balance this with public health and safety measures. The country is gradually building a regulatory framework that could potentially make it a leader in cannabis tourism and medical cannabis in Asia.
